SOUNDSWIFT — TERMS OF SERVICE
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the SoundSwift platform, including social networking features, video-hosting and streaming tools, messaging systems, creator monetization features, and the digital music storefront. By accessing or using SoundSwift, you agree to these Terms. If you do not agree, you must discontinue use of the platform.
2. Eligibility and Accounts
Access to SoundSwift is limited to approved users. You must provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. SoundSwift may suspend or terminate access at any time for any reason.
3. Platform Scope
These Terms apply to all SoundSwift features, including:
- Social networking and communication tools
- Video-hosting and streaming features
- Digital music uploads, sales, and storefront tools
- User-generated content systems
- Creator monetization and payout features
- AI-powered analysis, moderation, and security systems
4. User Content and Licensing
By uploading or posting content, you grant SoundSwift a worldwide, non-exclusive license to store, process, analyze, display, and use your content within the platform for operational, security, and moderation purposes. Commercial release or external distribution of your content requires a separate written agreement.
5. User Responsibilities
You agree not to:
- Upload infringing, stolen, or unauthorized content
- Post harmful, illegal, or abusive material
- Circumvent platform restrictions or security systems
- Engage in fraud, scams, or deceptive practices
- Manipulate sales, streams, or engagement metrics
- Use bots, automation, or scraping tools
- Impersonate others or misrepresent affiliation with SoundSwift
6. Marketplace Rules
Users selling music or digital goods must:
- Own or control all rights to the content they upload
- Provide accurate product information
- Not upload unlicensed samples, remixes, or derivative works
- Not artificially inflate sales or manipulate payouts
SoundSwift may withhold payouts or remove products if ownership is disputed.
7. Video and Social Features
Users must not upload copyrighted videos, broadcasts, or performances without permission. Users must not repost or redistribute other users’ content without authorization. SoundSwift may remove content that violates these rules.
8. Enforcement
SoundSwift may remove content, restrict features, suspend accounts, or permanently terminate access for violations of these Terms. SoundSwift may also report unlawful activity to authorities.
9. Disclaimers
The platform is provided “as is” without warranties of any kind. SoundSwift is not liable for data loss, unauthorized access, technical issues, or third-party actions.
10. Limitation of Liability
To the fullest extent permitted by law, SoundSwift is not liable for indirect, incidental, or consequential damages arising from your use of the platform.
11. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
12. Changes to These Terms
SoundSwift may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
